Rubi Holdings Group Inc. (“Rubi”), respects your privacy and is committed to protect the Personal Information (defined below) that you share with us. Generally, you can browse through the Rubi.io website (“Website”) without giving us any Personal Information. This Privacy Policy (“Policy”) describes how we collect and use your Personal Information when we need your Personal Information to provide services that you request (“Services”) or when you establish an account with us (“Rubi user account”) or choose to provide us with your Personal Information through the Website or via applications (“Apps”) used in conjunction with the Website.

Information Collection

“Personal Information” means any information that may be used to identify an individual, including, but not limited to, a first and last name, company name, email address, telephone number, postal or other physical address, birth date, gender, occupation, a credit card number (including expiration date) to process payment for products, Apps and/or services and such other information when needed to provide a service that you requested. Certain of our products, Apps and Services also store connection or session information such as time/date and length of collection, IP address, chat logs, location information and technician information, along with the files you upload, download, or access with certain Rubi Services (“Files”).

As you navigate through the Website and/or use our Apps or Services, certain information can be collected without your actively providing the information using various technologies, such as cookies, Internet tags or web beacons, and navigational data collection (log files, server logs, clickstream). Your internet browser or mobile device automatically transmits some of this information, such as the URL of the website you just came from and the Internet Protocol (IP) address and the browser version your computer or mobile device is currently using; the date and time you access the Website and the pages that you access while visiting the Website. This information is used for our internal/external marketing purposes, and to analyze trends and to improve our Website, products, Apps and Services.

Rubi collects Personal Information when you elect to use our software (including use on a free trial basis) or purchase an App, Service subscription or an upgrade. Rubi only uses such information in accordance with this Policy and applicable laws. By creating a Rubi user account or using our software or Services or accessing an App or an Upgrade, you acknowledge that Rubi and others are allowed to use your Personal Information in accordance with this Privacy Policy.

Choice/Opt-Out

When creating a Rubi user account or accessing other products or services on the Website, you will have the choice of whether and how you would like to receive correspondence from Rubi and our partners. Additionally, you will have the choice of whether you want certain information shared with third parties. Please note that opting out of having certain information shared with third parties may hinder your use of some of our Services. You may change your preferences at any time. You will not be included in any promotions, contests, sweepstakes, or programs unless you opt-in. All emails or other correspondence sent by us will include an option to opt out of any further such correspondence. Additionally, you can opt-out by contacting us by e-mail or postal mail at the address shown below. Please allow us a reasonable amount of time to process your opt-out requests.

Rubi and our third party affiliates may occasionally conduct polls and surveys in which you may be invited to participate. Such invitation may be random or may be based on non-identifiable information gathered by us or the third party. Your participation is completely voluntary and you may be asked to provide personally identifiable information in order to participate. Information gathered in connection with surveys or polls will be used only in connection with that survey or poll and will not be disclosed with any third parties unless specifically requested and consented to. You may opt-out of participation in any polls or surveys by changing your personal account settings.

Cookies and Tracking Technology

A cookie is a small data file that certain websites write to your hard drive when you visit them. Cookies cannot be used to run programs. A cookie file can contain information such as a user ID that the Website uses to track the pages you’ve visited, but the only Personal Information a cookie can contain is Personal Information you supply yourself. A cookie cannot read data off your hard disk or read cookie files created by other sites. Rubi also uses cookies to track user traffic patterns. We do this in order to determine the usefulness of our Website information to our users and to see how effective our navigational structure is in helping users reach that information. In addition to cookies, our Website uses a variety of technical methods for tracking purposes, including web beacons, which are small pieces of data that are embedded in images on the pages of websites. Rubi also uses these technical methods to analyze the traffic patterns on our Website, such as the frequency with which our users visit various parts of our Website.

Geo-Tracking Technology

Rubi provides services that enable dispatchers to view current job and technician locations and also provides information related to the location history of mobile devices or computers in your subscription. In order to provide this service, Rubi interacts with your mobile device or computer to determine your current location. Rubi periodically collects and saves this information regarding your current location. The information collected includes your present location, the current time, and an a unique identifier associated with your mobile device or computer (“Location Information”).

This Location Information is stored in our secure servers or in secure servers of a third party service provider according to our Data Security and Retention policies detailed below. You are permitted to access the Location Information for the mobile devices and computers included in your subscription in order for us to provide the services described above or for other services that we may add in the future. You are solely responsible for maintaining the security of your subscription and maintaining the privacy of Location Information after it is shared with you.

You may choose whether or not this Location Information is collected and stored. This choice is available at a mobile device or computer level or on a subscription-wide level. By default, you opt-in to having the Location Information collected and stored. If you opt-out, some functionality and services may not be available to you.

The Location Information is not shared with any third-parties (other than our third-party service providers).

How We Use Information Collected

Rubi uses Personal Information for several general purposes: to fulfill your requests for certain products and services, to keep you up to date on the latest product announcements, software updates, special offers or other information we think you’d like to hear about either from us or from our business partners, and to better understand your needs and provide you with better services. We may also use your Personal Information to send you promotional materials about goods and services (including special offers and promotions) either offered by Rubi or offered by third parties. You may opt out of receiving these communications by following the process specified above.

Some mobile devices allow applications to access real-time location-based information (for example, GPS). Our Apps currently do not collect such information from your mobile device while you use our Apps, but may do so in the future with your consent to improve our Services. In addition, some materials in your Files may contain such recorded location information, which we may use to optimize your experience. If you do not wish to share such geo-location information with Rubi, please do not load them to your Files. Also, some of the information collected from a mobile device such as an IP address can be used to approximate a mobile device’s location.

Some information collected using cookies and similar methods may sometimes be correlated with certain Personal Information, which is used in accordance with this Privacy Policy for various purposes, such as to monitor use of the Website and Rubi products and Services, enhance functionality and user-friendliness, and verify proper authorization of users.

Information Sharing and Disclosure

We may disclose to third parties your Personal Information when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of Rubi or its users; or (d) to protect Rubi’s property rights. If we provide your Personal Information to a law enforcement agency as set forth above, we will first remove Rubi’s encryption; however, Rubi will not be able to decrypt any files that you encrypted prior to storing them.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your Personal Information may be transferred as part of that transaction, but we will notify you (for example, via email and/or a prominent notice on our Website) of any such change in control or use of your Personal Information or Files, or if either become subject to a different privacy policy. We will also notify you of choices you may have regarding the Personal Information.

Our Website and Apps provides you the opportunity to opt-out of receiving communications from us when you elect to use our Apps, Services or software (included on a free-trial basis), or purchase a new subscription or an upgrade. Further, when you receive the requested communication, you are given the opportunity to unsubscribe from receiving any future communication or to change your information.

Unless you opt-in, Rubi will not transfer your Personal Information to third parties, except we may transfer your Personal Information without your consent to the extent required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the requirements of law or comply with legal process served on Rubi or the Website; (b) protect or defend the rights or property of Rubi, or (c) act in urgent circumstances to protect the personal safety, property, or privacy of Rubi’s employees, users of Rubi’s products or service, or members of the public. If you choose to provide us with your Personal Information, we may transfer that information within Rubi or to Rubi’s third party service providers with your permission. In addition, Rubi may send your Personal Information to other companies or people under any of the following circumstances: when we have your consent to share the information; we need to share your information to provide the product or service you have requested; we need to send the information to companies who work on behalf of Rubi to provide a product or service to you (we will only provide those companies the information they need to deliver the service, and they are prohibited from using that information for any other purpose); or we want to keep you up to date on the latest product announcements, software updates, special offers or other information we think you’d like to hear about either from us or from our business partners (unless you have opted out of these types of communications).

In addition, we may disclose your non-private, aggregated, or otherwise non-personal information with advertisers, business partners, and other third parties in an effort to customize or enhance the content and advertising on our Website for our users.

Your Ability to Review and Delete Information

Data Security and Retention

When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). Rubi safeguards the security and confidentiality of the data you send us with physical, technical, and managerial procedures. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. While we strive to protect your Personal Information, we cannot ensure the security of the information you transmit to us, and so we urge you to take every precaution to protect your personal data when you are on the Internet. Change your passwords often, use a combination of letters and numbers, maintains the secrecy of your password, and make sure you use a secure browser.

Our Website may contain links to websites operated by other companies. Some of these third-party sites may be co-branded with a Rubi logo, even though they are not operated or maintained by Rubi. Although we choose our business partners carefully, Rubi is not responsible for the privacy practices of websites operated by third parties that are linked to our site. We will retain your information for as long as your Rubi user account is active or as needed to provide you Services. If you wish to cancel your Rubi user account or request that we no longer use your Personal Information to provide you services, you may delete your Rubi user account. We may retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your Personal Information quickly upon request. Please note, however, that there might be some delay in deleting information from our servers and backed-up versions might exist after deletion. In addition, we do not delete from our servers files that you have in common with other users. We retain information provided by our users for an indefinite amount of time and by providing information to us, you consent to such retention. We will delete information from our databases as required by law. If you send us a written request to delete any of your account information, we will respond to such request and comply as we deem appropriate, in our sole discretion. Rubi may amend this Policy from time to time. If we make any changes in the way we use your Personal Information we will make that information available by posting a notice on the Website.

Children’s Privacy

Our website is a general audience site that does not target and is not intended for children under the age of 13. Rubi does not knowingly solicit or maintain Personal Information from or pertaining to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at support@rubi.io. If we become aware that a child under 13 has provided us with Personal Information, we will take steps to delete such information from our files.

International Privacy Protection

Personal information that we maintain is controlled and processed in the United States of America and/or other countries, which might not provide the same level of privacy protections as in your country of residence. For personally identifiable information collected from users in the European Economic Area and Switzerland, Rubi adheres to the Safe Harbor Privacy Principles administered by the U.S. Department of Commerce.
